Notice of the CCRCS: entry on the RCS of an EIRL

In notice no. 2013-026, the coordination committee of the Trade and Companies Register (CCRCS) has outlined the formalities and supporting documents required for sole traders with limited liability (EIRL) when already entered on the special register for sole traders with limited liability (RSEIRL) but has requested its entry on the Trade and Companies Register (RCS) whilst continuing with the same activities.

EIRLs should, in order to be entered on the RCS:

  • "comply with rules provided for the entry of any physical person, and notably declare information concerning estate for which provision is made under article R.123-37.5° of the Commercial Code" ;
  • "indicate the unique identification number (SIREN code) which is allocated at the time of declaring activities".

Consequently, all supporting documentation requested for entry on the RCS is required, with nothing relating to allocation of the estate. Allocation of estate identical to that declared with the RSEIRL should not be registered with the RCS.
No legal provision imposes an EIRL to declare the place of its declaration of allocation of estate to the RCS, but the clerk may however be notified of this either by verification at its own initiative in order to appear on the RCS, each time this is possible, or an observation indicating the place of registration.
