Prevention of company difficulties

First and foremost, prevention rests on detecting company difficulties. Registries at the commercial court are, for the presiding judge of the court, a favoured source of information. They are responsible for logistics and detection for departments responsible for the prevention of company difficulties. Alerts are also made by approved prevention groupings, works councils, members, shareholders, auditors (it should be noted that the alert procedure by the auditor is not applicable where a conciliation or safeguarding procedure is initiated by managers). Prevention is illustrated by the importance of the role of presiding judge at the commercial court through three series of provisions implemented by the registry: - publicity of entries of tax and social debts - convening the manager to a meeting - the obligation to file annual accounts subject to a penalty.
