This list will tell you the companies for which you can make a bid.

What is the deadline for making a bid?
Pursuant to article L. 621-57 of the Commercial code, third parties are eligible to submit takeover bids aimed at business continuity of the company.
NB: the bid is binding until the Court judgement adopting the plan, provided that this judgement is reached in the month that the administrator's report was filed.
If the deadline for the submission of bids has been fixed by the authorised representative, you will be informed that, by virtue of article 103-2 of the decree of January 27, 1985, the court can set a new deadline for the submission of new bids or improved bid of those submitted previously.

What should be included in the bid?
Any bid must be in writing and include:
• The exact description of the assets, rights and contracts included in the bid.
• business and financing plans.
• The price offered, settlement terms, the type of capital contributors and, where applicable, their guarantors. If the offer involves a loan, it must specify the conditions, in particular the term.

The bid may neither be modified, unless it is more favourable to the objectives mentioned in the first paragraph of Article L. 642-1, nor withdrawn. It binds the bidder until the court decides to adopt the plan. If the decision adopting the plan is subject to appeal, only the assignee remains bound by its offer.

How should the bid be prepared?
A hard copy must be sent to the address shown on a case-by-case basis under the heading " WHO TO SEND YOUR BID TO".
Only third parties to the company may submit a bid.
MAKE SURE you take note of the deadline for submitting bids if specified.
