Pursuant to Article 32 of Law No. 2014-40 of 20 January 2014, spouses of employees may voluntarily join the pension system for non employees when they stop being affiliated to the old age pension insurance system for non employees. For instance, divorce, death or retirement of the company director shall not prevent his/her spouse from joining the non employee system.

This voluntary insurance system concerns spouses of employers of artisans, traders, industrialists, farmers and liberal professionals (including lawyers). A subsequent decree will set out the terms and conditions of application of this mechanism, notably concerning the deadlines which should be respected by the spouse to request voluntary affiliation.
