On Wednesday, 28 January 2015, the Minister of Labour, François Rebsamen, presented an ordinance clarifying the new regulatory framework for part-time work.
In effect, as of 1st July 2014, part-time employment contracts, CDDs (contracts with a defined term) and CDIs (contracts with an unlimited term), must be concluded for a minimum duration of 24 hours per week, except with respect to an express request by the employee or professional agreement.
The ordinance clarifies a sensitive point raised by management: an employee having worked less than 24 hours as of 1st July 2014 (or having signed a contract for less than 24 hours before this date) and who wishes to work more, would benefit from a priority right without the employer having ever been obligated to favourably respond to the request as a 24-hour contract was not available.
