Legal representative
Legal representatives are appointed by legal decisions to act in the name and on behalf of and in the collective interest of creditors. However, in the event of default by the representative, any creditor appointed as an auditor may act in this interest (articles L. 622-20 and R. 622-18 of the Commercial Code). The general role is to defend the interests of creditors and to take certain actions for which it is solely and exclusively responsible. By way of example, we can mention the verification of credits, consultation of creditors on proposed payments of debts in the framework of a safeguarding plan, etc.
