Safeguarding (Proceedings)
Having been implemented since 1 January 2006, the safeguarding proceedings for companies are a direct extension of the prevention proceedings in place since 1984. It is applicable to all commercial, agricultural, civil or independent companies which, without being incapable of respecting payments, are struck with legal, financial or economic difficulties, either identified or likely. It is initiated by a company director.
